By registering for a Toft Photo Safaris tour, workshop, expedition or other program (program), you agree to the following photography tour terms and conditions.

Registration Policy

Registration in a Toft Photo Safaris tour, workshop or program (program) is not confirmed until a deposit has been paid, as per the deposit and payment schedule below. It is the participant’s responsibility to ensure that payments are made as per the payment schedule.

Some programs will have a modified payment schedule. In these cases, the payment schedule will be noted on the program page on the Toft Photo Safaris website.

Payment Policies

  • A non-refundable 25% deposit is due upon registration and is calculated based on the cost of the photo tour or workshop.

  • A second deposit of 25% of the expedition price is due 180 days prior to start of program. (If a participant is booking a trip within 180 days prior to start of program, then 50% of the price of the program is due upon registration).

  • The remaining balance (50%) is due and must be paid in full at least 90 days prior to departure. If a participant is booking a trip within 90 days prior to start of program, then the full cost of the trip (100%) is due at time of booking.

An email invoice should be sent at each installment alerting the clients who have not paid that payment is due.

A client that has not paid in full will not be eligible to join a Toft Photo Safaris.

Client Expedition Cancellation & Refund Policies

  • WE STRONGLY RECOMMEND THAT ALL CLIENTS PURCHASE TOUR INSURANCE to cover for unexpected cancellation reasons, sickness or inability to travel during the designated dates of the photo tour or workshop.

  • In order for a client to cancel their participation on a trip we must be notified in writing and sent to our office at 16655 Falcon Heights Rd., Ramona, California 92065. The below-mentioned penalties will be applied and computed as of the date of receipt of the written cancellation. If a participant needs to cancel, it is their responsibility to follow up and confirm that we received their cancellation request.

  • The 25% deposit is non refundable, except in extreme circumstances (such as death).

  • 90 or more to 61 days prior to the start date, we retain 25% of the total package price of the session being cancelled, and refund the balance paid to date (i.e. if a 50% deposit has been paid toward the session, we refund half of that deposited amount).

  • 60 to 31 days prior to the start date, we retain 50% of the total package price of the session being cancelled, and refund 50% of the total cost of the session (if only a 50% deposit has been paid by this time, that deposit is forfeit entirely).

  • Within 30 days of the start date of a workshop or expedition, 100% of the package price is due in full and is non-refundable.

Cancellation or Changes by Toft Photo Safaris

Toft Photo Safaris will make every effort to operate programs that have been advertised and for which registrations have been taken. However, Toft Photo Safaris reserves the right to cancel or change a program due to insufficient registrations and/or reasons beyond our control that might create unsafe or undesirable travel conditions for the participants. In the case of a program cancelled by Toft Photo Safaris, we will provide a full refund of any deposits or fees paid to Toft Photo Safaris toward enrollment in that program. Toft Photo Safaris is not responsible for, and will not be held liable for, any expenses incurred by the client in relation to planned participation in a cancelled Toft Photo Safaris program, including, without limitation, costs of travel, passports, visas, photographic or computer equipment, software, apparel, luggage, or supplies.

Medical Care and Insurance

Participants are responsible for arranging their own coverage of medical care and emergency evacuation insurance while traveling as part of a Toft Photo Safaris program. By registering and paying a deposit for a Toft Photo Safaris program, you warrant that you have confirmed that you have coverage for the costs of any treatments deemed medically necessary during your travel, including emergency evacuation if required, or that you will arrange for supplementary coverage prior to the start date of the program for which you are enrolled. Under no circumstances will Toft Photo Safaris or our insurers be responsible for the cost of medical treatment, emergency evacuation, or other complications due to medical emergency.

Travel Insurance

We strongly recommend that participants purchase a travel insurance policy to cover costs related to unforeseen trip cancellation, delays, interruptions and other unforeseen travel complications, cancellations due to circumstances beyond our control, emergency medical treatment and evacuation, and other unforeseen complications of travel. Toft Photo Safaris is not responsible for coverage of any such costs, nor can Toft Photo Safaris make exceptions to the aforementioned cancellation policies. Please note that some travel insurance coverages are only available if purchased within 14 days of making the initial deposit on the trip.

Travel Documentation and Preparation

You are responsible for ensuring that you have the proper travel documents for the destination(s) to be visited. Valid passports are required for all international travel. You should check with the appropriate consulate(s) or visa agencies to determine whether visas are required, and review your public health authority’s recommendations for health, immunizations, and safety.

You will be requested to submit certain information in advance of a Toft Photo Safaris program, which may include personal details, health information, passport information, insurance information, and other information that is necessary in order to arrange for travel and services. It is your responsibility to provide this information in the timeframe requested. If you do not provide this information when requested, we cannot guarantee that we can provide the full itinerary and services of that program for you. You will also be required to submit a signed released of liability or assumption of risk form prior to the start date of the program. If you do not submit the signed release of liability or assumption of risk prior to the program start date, you will not be able to participate in that program.

You are personally responsible for being in sufficiently good health and appropriate fitness level to undertake the program for which you have registered. By registering for the program and paying a deposit you certify that you do not knowingly have any physical limitations or other considerations of disability that would create a risk for you or other participants. We reserve the right to request a doctor’s statement of good health as deemed necessary or required.

Use of Image, Likeness, and Testimonials

We reserve the right to take photographs or videos during the operation of any Toft Photo Safaris program or part thereof and to use the resulting photography/video in whole or in part for promotional purposes, including, but not limited to advertising and publicity in print, electronic and social media. By registering and paying a deposit for a Toft Photo Safaris program, participants agree to allow their images to be used for such purposes. If a participant prefers that their image not be used, he or she is asked to notify the tour leader(s) at the beginning of their trip.

We also reserve the right to use, in all or in part, any written reviews you may provide to us in our advertising and publicity in print, electronic, and social media.

Leave No Trace

By registering for a Toft Photo Safaris program, you confirm that you understand that Toft Photo Safaris adheres to a Leave No Trace ethic with regard to its activities in nature and on public lands, and you agree to follow Leave No Trace best practices or other best practices as related to the area visited during the program to minimize and mitigate my impacts on places visited during Toft Photo Safaris activities.

Tipping

On safaris and expeditions, tips for guides, drivers, porters and servers in restaurants will not be included unless otherwise stated.

Single Supplements and Double Occupancy

All prices quoted are based on double occupancy. A single supplement (detailed in each individual itinerary) will be charged to participants who specifically request a single accommodation subject to availability. Single travelers who are willing to share with another single traveler (of the same gender) will not be charged a single supplement, subject to the availability of a roommate. However if a roommate is unavailable to share accommodations, then the full single supplement fee will be charged.

Defaulting on a Scheduled Payment

If a scheduled payment is not able to be met by a client or not paid on time, then the reservation will be at risk of being forfeited. A client that has missed a payment or is unable to make a future payment is responsible for contacting Toft Photo Safaris and requesting a payment extension. Each case will be evaluated independently and a solution will be determined at the discretion of the Wild Focus Expeditions leader.

Changes of Itinerary, Pricing and Cancellations

Toft Photo Safaris reserves the right to change an expedition itinerary, dates, and accommodation and or advertised trip leaders. If an itinerary must be changed or delayed for reasons outside of the control of Toft Photo Safaris (e.g. political unrest, strikes, severe weather, government intervention, acts of nature, war, earthquakes, flooding etc.) then the cost of delays or changes is not included.

At Toft Photo Safaris, in order to secure the best possible pricing and availability we are often paying large sums of money to operators up to two years in advance. While we do everything in our power to keep the prices the same as published we are however occasionally faced with exceptional cost increases or currency fluctuations that we are unable to accommodate. For this reason advertised prices are subject to change. All prices are quoted in United States dollars $US and must be paid in $US.

Toft Photo Safaris reserves the right to cancel any trip prior to departure for any reason whatsoever, including logistical problems that may impede trip operations or insufficient sign-up of participants.

If a trip is canceled due to force majeure (acts of nature, war, labor strikes, earthquakes, flooding etc.) Toft Photo Safaris will promptly refund the portion of the trip cost not already advanced to suppliers and use its best efforts to recover and refund the balance as promptly as possible. However Toft Photo Safaris does not guarantee the recovery or refund of any or all of the advanced payments made.

In the case of a trip receiving insufficient sign-ups this will normally be canceled a minimum of two months prior to departure. In such a case Toft Photo Safaris will make the utmost effort to refund participants in full. Toft Photo Safaris is not responsible for expenses incurred by trip participants in preparation for the canceled trip (e.g. non-refundable advance purchases, inoculations, equipment, visa fees etc.) or for any additional arrangements the trip member may have solicited prior to the group departure date.

Photography Tour Participant Obligations

It is the responsibility of each Toft Photo Safaris trip participant to select a trip according to their physical ability and interest and to be of sufficiently good health. It is the full responsibility of each trip member to be fully prepared for the trip with reference to the Toft Photo Safaris pre-departure information (e.g. ensure validity of passport, visas where necessary, travel insurance, inoculations, air-travel, medications, equipment, etc.). It is also the full responsibility of each trip member to make Toft Photo Safaris aware of any medical or dietary conditions at the time of booking. We reserve the right to deny trip participation accordingly.

Photographic Model Release

Toft Photo Safaris reserves the right to take photographic or video records throughout any of its expeditions of trip participants. Participants should be aware that Toft Photo Safaris has the right for use of any such photographic or video records for promotional and/or commercial purposes without remuneration to the participant. Any individual who does not wish to be represented in photographic or video records should notify Toft Photo Safaris in writing before the end of the expedition and their wishes will be respected.

Limitation of Liability

Toft Photo Safaris gives notice that it does not own or operate any entity that provides services for your expedition, including but not limited to transportation providers, hotel accommodations, food service providers, local guides and porters, equipment suppliers, ground and safari operators, etc. These services are purchased from various independent suppliers who are not affiliated with Toft Photo Safaris in any way. Toft Photo Safaris, its owners, employees, officers, or contractors shall not be held liable for any negligent or willful act or failure to act of any such person or entity, nor for any act or inaction of any other third party not under its control. Without limitation Toft Photo Safaris is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience, or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation, any willful or negligent act, failure to act, or breach of contract of any third party, such as an airline, train, hotel, restaurant or food supplier, bus, taxi, van, or safari operator, or local outfitter or guide, whether or not it uses the Toft Photo Safaris name, which is expected to or does supply any goods or services for your expedition. Toft Photo Safaris cannot be liable for any loss, injury, death, or inconvenience due to delay or changes in schedule; overbooking or downgrading of accommodations; technical problems of any aircraft, vessel, automotive vehicle or other equipment or instrumentality; strikes; war; insolvency default of any third party; acts of government; bites or attacks by animals, insects or pests; sickness; the lack of appropriate medical care; evacuation to same, if necessary; weather; strikes; acts of nature; acts of terrorism or the threat thereof; quarantine; epidemics or the threat thereof; criminal activity; or any other cause beyond its control. In no event will Toft Photo Safaris be responsible for incidental, consequential or special damage or loss suffered by any person. By confirming your participation in this program, you understand, agree with, and agree to be legally bound by the terms of the release and waiver of liability set forth herein.

Compulsory Arbitration

The parties agree to resolve any controversy or claim concerning this website, web page, the literature for a trip, or the trip itself, by binding arbitration in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. In any such arbitration the substantive but not procedural law shall apply. This agreement to arbitrate does not waive or modify the liability release contained in this document. The arbitrator and not any federal, state or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.
